This agreement is made and entered between the owner of the vehicle hereinafter called “Lessor” and the renter of the vehicle hereinafter called “Renter”.

Lessor accepts obligation to rent a vehicle to the Renter under the following conditions. The Renter acknowledges and agrees to the following:

1. The Renter received the vehicle in good shape and condition. Vehicle must be returned at the same shape and condition with all tools, tires and other parts included at the day of rental.
2. The rental period is defined on the first page. If the Renter wishes to extend this period, they must inform the Lessor 24 hours prior to expiry time. The Lessor has the right to claim the vehicle back from the Renter in cases of misuse, hazardous or unskillful driving of the vehicle.
3. The Renter is held responsible to keep the vehicle in good condition. They must check oil and water level during period of rental. They must also pay cost of fuel. Any forcing of the kilometer counter by the Renter is subject to his/her prosecution.
4. Lessor shall not be responsible for any damage to property or shred having been transported by the Renter or other person in, or upon the vehicle before, during or after period of rental or after the return of the vehicle to the Lessor’s office.
5. The Renter shall always keep vehicle locked when not in use and take all precautions to prevent its theft, or that of its accessories.
6. Lessor has taken all necessary measures to prevent any mechanical fault of the vehicle and shall not be liable for any loss or damage occurring during rental period whatsoever.
7. Renter shall pay the Lessor the sum of:
   a) All basic delivery and collection charges if applicable to the rental.
   b) All time and mileage charges included at the rates shown in this agreement (mileage to be determined by reading factory-installed odometer).
   c) Rental insurance service fees.
   d) All taxes included to above services rendered.
   e) If the Renter delays the car after the arranged returning, charging will be 1/5 of daily fee per hour, for unlimited mileage.
8. Vehicle shall not be used:
   a) Against the terms and conditions of this agreement.
   b) To carry persons or property for hire.
   c) To carry more persons than it is licensed for.
   d) To transfer or carry heavy luggage or badly smelling goods, narcotics.
   e) To tow other cars or trailers.
   f) In any race test or contest.
   g) By any person under the influence of alcohol or drugs.
   h) By any person without the advanced authorization of the lessor.
   i) For any use against the Hellenic Law.
   j) Outside of the island.
9. Renter is liable for and shall pay any parking and traffic violation tickets during rental period even if these sums are demanded after expiry of this contract.
10. SAFETY ADVICE

• I do not drive under the influence of drugs, alcohol or medication.
• I do not have serious injuries or health conditions.
• Neither I nor my passenger is pregnant.
• I respect the minimum age of 18 years to drive the vehicle.
• I will wear protective equipment such as a safety helmet. Further, I will check that my passenger also equipped himself the same way.
• I was able to familiarize myself with the performance and operational characteristics of the vehicle, and I am familiar with the safety instructions for it. I understand the risks resulting in the use of vehicles, either as a driver or as a passenger.
• I will always follow the guide without leaving the vehicle line and without driving in a zigzag. I will not attempt to overtake or make stunts, jumps or any other form of dangerous maneuvers.
• I will drive at a moderate speed taking into account the condition of the terrain, the visibility and my experience in the use of the vehicle. I will always be ready to break or change my path in case of an emergency.
• I will comply at all times with the safety instructions given by the guides. I will be mindfully maintaining a safe distance from the vehicle in front of me and I will not leave the preexisting tracks.
• I declare responsibly that I have inform for the right and legal use of the highway car rental Iosif Gounadakis. Therefore for any damage during the use by me and my co-driver we take full responsibility.
• Do I have allergies?
• I have taken the necessary measures (medicines) in case of allergic schock.

1. c) This insurance policy is liable for coverage up to the amounts defined in the main insurance contract that is kept at the Lessor’s office. The renter is solely responsible for damages in excess of those amounts.
   Any damages on the car caused by the Renter and up to the amount of 800 Euro are not covered by any insurance policy.
2. d) This term is part of the main agreement and is validated by the Renter’s signature on the first page of this form.
3. In case of accident or any other incident the Renter is obliged to follow the insurance procedure as follows:
   a) Call the police,
   b) Obtain names and addresses of any eye witnesses,
   c) Do not accept any responsibility or fault for the accident until the police has found the liable party,
   d) Contact immediately by phone or other means, the Lessor,
   e) Obtain all relevant information from the third party or parties (plate numbers, names etc),
   f) Complete and sign an accident report within 24 hours from the time of the accident describing all details and submit it to the Lessor’s office.
4. Lessor cannot be waived from any legal claim reported on this agreement or contained in legal terms which stand by law beyond this contract.
5. Delivery difficulties may compel the Lessor to cancel a reservation or replace the vehicle.
6. Renters of 23 years of age or less, are fully responsible for any damage caused to the vehicle.
7. We have no obligation for any refund before the end of rental agreement.
8. Any and all disputes, which may arise between the Lessor and Renter, shall fall within the exclusive jurisdiction of the courts of Chania in Crete.
